Lawsuits filed against beach club

Two foreclosure lawsuits are currently active against Serenata Beach Club and its owners, according to documents filed in the Circuit Court of the Seventh Judicial District. The club remains open.

World Business Lenders (WBL) of Elmsford, New York, filed suit on June 30 against Serenata, Bernoulli Growth Capital, Molly Ann Butler and Jeffrey Byron Butler.

WBL claims it made a $1,320,000 loan to the borrower on Aug. 9, 2022, and that repayment was guaranteed by the defendants. The complaint alleges that payments were not made on the loan by the due date beginning in December and that the parties entered into a settlement agreement, but that only one payment was made in the amount of $125,000.

WBL claims that, as of June 28, it is owed $2,068,576, which is the sum of the principal, interest and prepayment premium. In addition, WBL claims it is owed a daily accrual of $1,612 and other fees and costs.

According to the complaint, WBL is requesting the court foreclose on the mortgage and direct the Clerk of the Court to sell the property in a foreclosure sale.

DLP Lending Fund of Delaware with a branch in St. Augustine filed suit against the same three defendants on July 6, claiming that Serenata Beach Club executed a promissory note on April 20, 2022, in the amount of $8,586,000. DLP claims Serenata failed to pay all amounts that were due by May 1, 2023.

The Serenata Beach Club did not immediately respond to a request for comment.
