In March 2005 Cynthia Beckwith purchased two plots of land in Vilano Beach for a total of $215,000 at a time when similar lots were being sold for more than $250,000 apiece.

The same day she signed the deed on the properties, she sold one of them to another buyer for $215,000 — essentially getting her a lot at no cost.

Five months later she married then County Commissioner Jim Bryant, who is now campaigning to return to the commission as the District 4 representative.

Bryant, who served as a commissioner from 1996 until 2008, lives with his wife in a house built on the lot she essentially got for free.

The Property

In November 2002, an application for zoning change for the land located at 166 Oak Avenue in Vilano Beach was filed with St. Johns County. The project name was North River Island and the applicant, Mark Ambach of Ponte Vedra, requested the zoning classification be changed from commercial highway and tourist to residential single family. According to the application for rezoning, the present use of the property was listed as "vacant, unfinished marina" and an attachment to the application for rezoning states, "the site was designated and approved for a marina but the marina project failed. The use proposed is compatible with the residential characteristics of the surrounding neighborhoods and is consistent with the comprehensive plan designation of Residential - Density C."

The firm of Pappas, Metcalf, Jenks and Miller P.A. was listed as the contact for the rezoning application.

The Developer

Mark Ambach, John Kenny and John Deneen formed North River Island LLC, which they filed as a LLC in the state of Florida on Feb. 27, 2003.

On March 4, 2003 Pappas, Metcalf, Jenks and Miller P.A. on behalf of the Barco Family Trust, then owners of the land in question, presented an application for rezoning to the commission.

As chairman of the commission, Bryant signed Ordinance 2003-15, designating the property residential single family — the rezoning became effective March 10, 2003.

The Woman

Bryant said his marriage to Lisa Lee Bryant went south long before the official January 2005 dissolution date. He said Cynthia Beckwith was an old friend from pharmacy school who he reconnected with in 2003 at a conference.

Bryant and Beckwith began planning for a life together, which they hoped to begin once Bryant got divorced. At the time, theirs was a long distance relationship. Bryant remained in St. Augustine and Beckwith lived in De Leon Springs.

According to Bryant, Beckwith wanted to relocate to St. Johns County and was looking to purchase property where they could eventually build a home together. He told The Recorder he was helping Beckwith shop for property at the time.

The Deal Opens

Beckwith signed a contract to purchase two plots of land (labeled lots 4 and 6) from Mark Ambach for $215,000. The contract was dated June 16, 2003.

According to Bryant, he was approached by Ambach regarding property Ambach had recently acquired and was looking to sell.

Listed in the contract Beckwith signed with Ambach were two conditions — the first was that the sale would not close until after July 1, 2004. The second condition was that it was understood that the buildable area in lot 6 was very limited and might not accommodate a house.

Bryant said a survey map provided by Ambach prior to placing the lots under contract

showed the buildable area on lot six was compromised by wetlands. He said he was under the impression that they would not be able to build on the lot.

He also said he and Beckwith continued to look at other property even though she had contracted to buy the two lots from Ambach.

 

The Final Plat

In July 2003, weeks after the Ambach contracted to sell the lots to Beckwith, North River Island LLC purchased portions of the rezoned land for $4.7 million from the Barco Family Trust.

Bryant and Beckwith were married in August 2005.

The final plat for North River Island was not approved until August 26, 2003 with the adoption of Resolution 2003-159. At the time of the vote to approve the plat, Bryant was chairman of the commission.

The Donation

On November 3, 2004 the commission, with Bryant representing District 5, adopted Resolution 2004-328, accepting the donation of park and conservation land from North River Island LLC. Included in this dedication were lots directly behind and adjacent to the lots Beckwith had under contract.

The Deal Closes

On Jan. 7, 2005, John Kenny Construction Company (Kenny is one of the partners in North River Island LLC) sold "Lot 2, Block CC, Unit "A" Surfside" to Jim and Nancy McFauls for $250,000.

On March 7, 2005, Beckwith’s purchase of lots 4 and 6, the contracted land from North River Island LLC, closed for $215,000.

On the same day, Beckwith sold one of the lots (lot 6) to J-Mac Construction for the same price she’d just paid for both lots — $215,000 — which meant she’d essentially paid nothing for lot 4.

McFaul, who had two months before purchased lot 2, owns J-Mac Construction.

The Missed Connections

Bryant said he was not aware of the connection between Ambach and North River Island LLC at the time Beckwith purchased of the land.

"I would say that there was no shady part on our actions," he said. "It wasn’t orchestrated on my part."

Bryant said he was surprised when The Recorder showed him the connections between Ambach, North River Island LLC, Kenny, J-Mac Construction and the McFauls. He said he had no idea how the deal to sell lot 6 to J-Mac was arranged.

"It happened so fast. I assumed it was on the up and up," he said.

The Law

Florida statutes governing standards of conduct for public officials say public officials should exercise care anytime they accept something of value.

Should Bryant have known that Mark Ambach and John Kenney were affiliated with North River Island LLC and that the deal that resulted in Beckwith getting lot 4 for free involved another company that had done business with the developers?

A 1980 advisory opinion from the Florida Commission on Ethics indicates the law places the burden on public officials "to exercise reasonable care in determining whether a particular payment or thing of value has been given with the internet to influence his official action."

It further states that "assuming the donor is in a position to be benefited by the officer’s or employee’s action, the officer should weigh the value of the thing received against the ostensible purposed for its being given. The larger its value, the more difficult it should be to justify its being given for any reason except to influence."

St. Johns County spokeswoman Karen Pan said County Attorney Patrick McCormack hosts a training session for commissioners that is designed to help them better understand the state’s ethics laws, among other things. In addition, Pan said, commissioners can go through in-depth training through the Florida Association of Counties at their discretion.

Former state attorney John Tanner, when told the facts contained in this story but not the names of the parties involved, said, "There are questionable circumstances that could have been avoided with perhaps a more diligent inquiry into the parties."

Tanner added that whether the commissioner knew or not may be moot. He said that under current laws he wasn’t sure he could be "tagged" with another person’s actions — not his spouse at the time — even though later he benefited from it.

If Beckwith had stopped seeing Bryant after she purchase the lots and sold one of them to J-Mac, but before she and Bryant were married, Bryant might not have received any benefit from the land deal.

But as things turned out, Beckwith, who is now Cynthia Bryant, has spent the past several years living with Bryant in a 2,955 square foot house they built on lot 4. The house is currently for sale, listed at $999,000, according to an MLS listing on Yahoo Real Estate.

Bryant is also renting a home in Ponte Vedra Beach to qualify as a resident of District 4, and plans to relocate here if he wins the primary election Aug.24.

Great article! Now there just need to be an article on how he has flown Roger Osteen's expensive planes free of cost for years. No rental charge, no fuel charge, completely free and completely illigal.

If you look at the Property Appraiser's website and pull up the house that Jim and Cynthia Bryant own (of course the house is only in Cynthia Bryant's name) at 129 Oak Avenue, everyone should be appalled that for an almost "million dollar house" they are only taxed only $263,000. What is going on at the Property Appraiser's office? MLS Number for the Bryant house is 510969. Folks - look it up. All of us who have older homes and not as nice amenities are paying more in taxes than poor Mr. and Mrs. Bryant. The Bryant's have some explaining to do on why they don't pay their fare share.

I happen to look up the property appraiser website ALSO, and the amount of taxes that was paid by Mr and Mrs Bryant were over $6000 annually. If CURIOUS DOES NOT know how to properly to look up and report correct information CURIOUS can call the property appraisers office for assistance to educated themselves before posting untruths and learn how to properly look up PUBLIC infomation.

I am curious why a guy who was a sitting Commissioner was regularly flying airplanes that belong to the developer of Nocatee, the County's largest development, at no cost??? Maybe Bryant didn't run in 2008 because he was scared the FBI would get him too!

We don't need Jim Bryant back in office bullying the county employees like he did. Bryant and his cronies Stern and Adams are as unethical as they come. Ponte Vedra does not need him or want him to represent us. I looked at the property appraisers office and the taxable amount that Jim will be paying on his house this year is a little over 263,000. Something isn't adding up. I looked at mine and I will be paying more for a house that is quite a bit less in value and older than his. So, I think I have to agree with the above post that something is not right here.

I hate political mudslinging. Review of County Records contradicts this entire story. Research on any candidate brings up "questionable" content. It always does because everyone finds a need to stir up a pot making stew out of stone soup. The media always has to get it's "digs" I'm sure next weeks story will be attacking someone else maybe they will attack current county administration for supporting the legalization of drugs? The whole thing just needs to turn over.

Resident...there are documents showing copies of payments made for the use of the plane. I don't like any politician but let' make sure to be accurate before accusatory.

I don't know why anyone is up set. The article was well documented. No one gets free land with out a reason. James plea of ignorance is what all politicians say when confronted with their questionable behavior. I'm not sure there is any room on the Board for any more hanky panky in these troubled times or for that matter at any time.

This is stupid. I mean first of all he didn't even buy it it was bought by a woman who later became his wife. Second the land was supposed to be a marina until all the rich annoying beach residents begged the commission to rezone it. One lot was thought to be unbuildable so the price was really for empty space. Turns out that wasn't true. Who wouldn't want to make out on a good real estate deal? Hell I would have done it. And it wasn't the house that Jim built it was the house that Cynthia built and Jim married the lady. So damn what. Who cares. Is this really what is "newsworthy?" I agree with the above, let's focus on the assistant county administrators video performance fighting for the legalization of drugs through LEAP. He is already in there. This whole damn county is corrupt!

"Pappas, Metcalf, Jenks and Miller P.A" I hope this isn't the Pappas running for Judge. The guy that owned this property long ago killed himself. He was a Bail Bondsman. His wife lives on the Point. Many think he was murdered. That property has the voodoo on it. Lots of dirty deals over the years

This is a great story. Needs to be broadcast to a larger audience. Developers and amateur "near-crooks" have ruled that board for too many years. PLEASE, out with the old self-interest types. District 4, WAKE UP! There has got to be a better choice for representation than someone like this.

The simple sad facts are that Jim Bryant is corrupt. The airplane talked about by "Resident" had the tail numbers N8160C. Look it up in Florida corporate records. O'Steen now has another airplane or two that are used by Bryant. There use was offered by Bryant to new Commissioner Mark Miner and to Mark's credit, he was offended and desolved his friendship with Bryant. The U.S. Attorney needs to open a Grand Jury docket on Bryant. Sad but true.

When talking about Tom Manuel read what the law calls "entrapment". Coach Moses Floyed was gotten rid of for a while with phoney charges when he was on the County Commission so that the vote for the WGV development would go the right way. I looked up the tail number of the plane in question zzz that plane, a single engine 4 seater is owned by another plane a single engine 4 seater, same model. This should be investigated.

This article is only the tip of the iceberg, if the rumors about his 12 years on the commission have any substance. Why has Bryant gotten a free pass all these years? These rumors about Jim Bryant have circulated for years. Such as his free and flagrant use of a developer's aircraft, rumors of bogus real estate transactions and of course the one about his free lot and his million dollar house, which appears not to be a rumor at all. Where is the investigation? Where is the media coverage? Where is the public outrage? Could it be that we look the other way when corruption is suspected of a local politico yocal who's history is granting special interest groups largess from the public treasury, but when an outsider (Tom Manual) tries to horn in on the gravy train, that is a different story. If Manual had been judged by the same yardstick used by Jim Bryant, he would still be taking developer's money in paper bags at fancy restaurants. It's hard to believe that Jim Bryant would get a pass to walk back into public office without raising an eyebrow.

Forget the States Attorney. The real charges will hit when one of the rat pack listed by Rtiredlawman rolls over on the rest of the pond scum. Frankly, Jim sounds like the best one to do that job. Let the U.S. Attorney get off his dead afterburner and spend some of that federal stimulus money cleaning up our county. I vote that after conviction (all these criminals are considered innocent until proven guilty) we lobby the Bureau of Prisons to send the lot on a 2 to 5 year cruise to Gitmo!

Reading these post is a joke. Look at who is defending Jim Bryant. His relatives who got a free job from him? Hello....his current wife was his mistress when she got the free lot. So much for character, Joy. Developers who had him in their pockets for years? What's a ;ittle free air time when I am getting Jim's support for Nocatee! The plane needs to be investigated. As for Stern, she STILL gets numerous checks from the same address, all with interest in rapid development with a reduction in impact fees. Wake up SJC. Send these thieves packing.

I read the article and the posts. The article did have some "factual" information. Then there were some errors with typos and other minor substance issues. One big fact I see missing. How come the Recorder did not contact J-Mac, they purchased the property to get his take on why it was sold to Cynthia? This is a very large question that was not answered. I am a regular citizen who is not attached to the political machine of St. Johns County and I still am a supporter of someone who was on the Board for 12 years compared to the average 1 term commissioners. How does anything get accomplished by the high turnover rate we see on a consistent basis? There are other boards of county commissioners in FL who have been there for 20 years. These counties benefit from the longevity of a great working relationship! Reading this as a tax payer and not as a total mess from the inside, I find it hard to believe to attach Jim to this farfetched land deal. These are the same transactions the county does on a daily basis, so maybe he is a product of the environment he was brought up in. Lets get to the substance issues with this story. Lets look at the commissioners who have reaped the benefit from the county's taxpayers on a consistent basis. Look at the commissioners who do one term and out. They get a retirement and health insurance paid by the county. No other county employees work for a minimum of 4 years and get their benefits paid for life! Of course, I am following in the trend above and just repeating hearsay, but once the damage is done, there is no taking the actions or words back. One thing the constituents need to look into is the expense paid to the commissioners throughout their 4 year term. I think this would be appropriate to investigate.
